Upwind Aviation
1. Acceptance of Terms
By accessing this website or participating in any flight training, discovery flight, aircraft rental, ground instruction, or related services offered by Upwind Aviation (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions.
If you do not agree, please do not use this website or participate in our services.
2. Services Provided
Upwind Aviation provides:
Discovery flights
Private pilot training
Instrument rating training referrals
Commercial pilot training
Time-building programs
Ground instruction
Aircraft rental (when applicable)
All services are subject to instructor availability, aircraft availability, weather conditions, FAA regulations, and operational considerations.
3. FAA Compliance
All flight training and rental activities are conducted in accordance with:
Federal Aviation Administration (FAA) regulations
Applicable Federal Aviation Regulations (FARs)
Instructor and aircraft limitations
Airport and airspace requirements
Students are responsible for maintaining required FAA documentation, including:
Valid government identification
FAA medical certificate (as required)
Student pilot certificate (when applicable)
4. Assumption of Risk
Aviation activities involve inherent risks, including but not limited to mechanical failure, weather hazards, turbulence, and unforeseen circumstances.
By participating in flight activities, you acknowledge and voluntarily assume all risks associated with aviation training and aircraft operations.
A separate signed liability waiver may be required prior to participation.
5. Scheduling & Cancellations
A minimum of 24 hours’ notice is required to cancel or reschedule lessons.
Late cancellations or no-shows may result in a cancellation fee.
Weather-related cancellations are determined at the discretion of the instructor in the interest of safety.
Upwind Aviation reserves the right to reschedule lessons due to maintenance, safety, or operational needs.
6. Payments & Refunds
Payment is due at the time services are rendered unless otherwise agreed in writing.
Block-hour packages, if offered, are non-transferable unless approved by management.
Refund policies for prepaid flight time or deposits will be outlined in individual training agreements.
7. Student Conduct
Students must:
Follow all instructor directions
Comply with FAA regulations
Refrain from unsafe or reckless behavior
Maintain professionalism in and around aircraft
Upwind Aviation reserves the right to terminate training for safety violations, non-payment, misconduct, or failure to comply with regulations.
8. Aircraft Use & Damage
Students operating aircraft (solo or rental) may be financially responsible for damage resulting from negligence, violation of FAA regulations, or failure to follow instructor guidance.
Insurance or insurance deductibles may apply as outlined in separate rental agreements.
9. Website Use
You agree not to:
Use the website for unlawful purposes
Attempt unauthorized access to systems
Copy or reproduce content without permission
Interfere with website functionality
All website content, branding, and materials are the property of Upwind Aviation.
10. Limitation of Liability
To the fullest extent permitted by law, Upwind Aviation shall not be liable for indirect, incidental, or consequential damages arising from:
Participation in flight training
Use of aircraft
Website access
Delays due to weather or mechanical issues
11. Modifications
Upwind Aviation reserves the right to modify these Terms & Conditions at any time. Updated versions will be posted on this website with a revised effective date.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Arizona.
